Spouse Visa Extension After 5 Years

Spouse Visa Extension After 5 YearsIf you have renewed a spouse visa and you have now held it for 5 years, you may be eligible to apply for Indefinite Leave to Remain (ILR) in the UK. A spouse visa can be a route to ILR, provided that you meet the eligibility criteria. We can provide expert assistance if you want a spouse visa extension after 5 years and represent you in applying to move from a spouse visa to ILR.

At Halliday Reeves, we deal exclusively with visas and immigration and our solicitors are genuine experts in this complex area of law. We have secured visas and ILR for thousands of clients, and we hold the Law Society’s accreditation for immigration and asylum work at an advanced level. This recognises both our legal expertise and our strong standards of client care.

When applying for a spouse visa extension or ILR, you need to ensure that your application is strong and that the right documents are sent to UK Visas and Immigration to prove your eligibility.

We can work with you to identify the best evidence in support of your application, obtaining documents and certified translations where necessary.

If you need advice about a spouse visa extension after 5 years, enquiries@hallidayreeves.com or fill in our Contact Form and we will be happy to help. You can also speak to us on 0330 133 7777.

Can I Get A Spouse Visa Extension After 5 Years?

Having a spouse visa for five years is a possible route to ILR in the UK. A spouse visa is granted for 2 years and 9 months and can be renewed for 2 years and 6 months. This means that once a visa has been renewed, if you abide by the terms of the visa, you may be eligible to apply for ILR if you are on the 5-year route.

If you move from a spouse visa to ILR, you will no longer need to apply for visa extensions as you will have settled status in the UK. You will be able to live and work in the UK and you may ultimately be able to become a British citizen.

Eligibility To Move To ILR From A Spouse Visa

To be eligible to move from a spouse visa to ILR, you need to satisfy UKVI on the following points:

  • Your spouse or civil partner is a British or Irish citizen or is settled in the UK
  • Your relationship is genuine and subsisting, and you have lived with your spouse or civil partner in the UK during the period of your spouse visa
  • You intend to keep living with your spouse or civil partner
  • You are of good character; this includes the requirements that you have not been convicted of any serious criminal offence, you have not breached your visa conditions, and you have not been dishonest in your ILR application
  • You meet the minimum financial requirements, including in respect of any children who will also be applying for ILR
  • You have adequate accommodation in the UK and can pay for this without recourse to public funding
  • You meet the English language requirement
  • You have passed the ‘Life in the UK’ test
  • You have spent 60 months in the UK under a spouse visa

You can also apply for ILR for dependent children who have held family visas for the same period of time.

Documents To Support A Spouse Visa Extension Or ILR Application

It is essential to provide sufficient paperwork with your application to prove that you satisfy the above points. This will generally include:

  • Your passport or other valid photographic travel identity document
  • Your spouse or civil partner’s passport
  • Evidence that you have been living together in the UK for the required period
  • Evidence that you have adequate accommodation for yourselves and any children or other family members
  • Bank statements, payslips and tax returns that show that you meet the minimum financial requirement
  • The results of an approved English language test
  • The results of a ‘Life in the UK’ test

When Can You Apply To Move From A Spouse Visa To ILR?

You can apply for ILR from a spouse visa up to 28 days before your visa expires. You will also need to have been in the UK for 59 months of the 60 required for eligibility.

How To Apply For Spouse Visa UK

An application for a UK spouse visa is made online. Before you start the application process, you should check that you have the right documents available to show UK Visas and Immigration that you meet all of their criteria.

We can go through the documents you have available and identify which will best demonstrate your eligibility. Where documents are missing, we can take steps to secure replacements. We will also ensure that any documents that are not in English or Welsh are accompanied by a certified translation, as required.

Our team can then prepare a draft visa application and provide you with a representation letter for the visa authorities.

Once all of the necessary documents have been compiled, the application can be submitted, together with the fee.

How Long Does It Take To Apply For Spouse Visa UK?

The length of time for a spouse visa application depends on the availability of the documents that you will need. These will include items such as:

  • A valid and up-to-date photographic travel identity document, such as a passport
  • A copy of the photo page and visa stamps in your expired passports
  • Your biometric information
  • Your marriage certificate or civil partnership certificate
  • Items such as correspondence, photographs and plane tickets that provide evidence of your relationship
  • Bank statements and other financial documents that confirm that you meet the minimum income requirements
  • A copy of the lease agreement in respect of your accommodation
  • The results of an approved English language test
  • Tuberculosis test results, where necessary
  • Details of any criminal convictions
  • Details of any previous visa applications

If all of the required information is provided to UK Visas and Immigration, they aim to provide a decision within twelve weeks if you have applied from outside of the UK. If you apply from inside of the UK and you meet the requirements, they aim to respond within eight weeks.

In some cases, it may be possible to pay for a faster decision, and we can discuss this with you if it is something you would like to consider.

The process of securing a sponsor licence is complex and you will have to satisfy UK Visas and Immigration that your business is eligible and also that the positions you intend to offer to immigrant workers are eligible.

You will need to set up management and reporting systems to comply with the ongoing rules of running a sponsor licence.
We can prepare the strongest possible sponsor licence application on your behalf and ensure that you have the infrastructure in place to manage the licence once it has been issued. We will advise you on issues such as appointing individuals to certain management roles, as required by the rules, and ensuring that you remain compliant when issuing Certificates of Sponsorship.

If you have had a sponsor licence downgraded from an A-rating to a B-rating, we can advise you on the issues you need to address and how best to implement the action plan you will have been provided with. It is usually the case that downgrading occurs because the right processes are not in place to run the licence or information has not been provided when requested. We will work with you to establish what is needed and ensure that you can regain an A-rating within the three months allowed.

When Can You Use A Business Visit Visa?

There are strict limitations to the work that you can carry out on a business visit visa and you cannot sell goods while in the UK or work for a UK business. Permitted activities include:

  • Attending meetings and conferences
  • Negotiating and signing contracts
  • Promoting your business at trade fairs
  • Attending training for your work that is not available in your home country
  • Site visits and site inspections
  • Overseeing delivery of goods and services provided by a UK company to your overseas company
  • Training UK employees of your overseas company
  • Servicing and repairing equipment, to include IT equipment and software, if your overseas company has a contract with a UK business

Certain professionals can also carry out some permitted activities in the UK under a business visit visa. This includes those employed overseas as:

  • an archaeologist
  • a camera operator
  • a driver
  • an internal auditor
  • a market researcher or analyst
  • a personal assistant
  • a professor from an overseas academic institution
  • a religious worker
  • a scientist or researcher
  • a sports person or sports official
  • a translator or interpreter

If your reasons for visiting the UK for business fall outside of these activities and professions, you may be able to apply for another type of work visa. We can advise you of the right choice.

Am I Eligible For A Business Visit Visa?

To be eligible for a business visit visa, you need to prove to UK Visas and Immigration (UKVI) that:

  • You intend to leave the UK after your visit
  • You do not intend to live in the UK by making frequent or successive visits
  • You can support yourself and any dependants while in the UK
  • You can pay for your return trip

How Do I Apply For A Business Visit Visa?

A business visit visa application should be made online before you travel to the UK. You will need to provide extensive information about your background and the circumstances of your visit, including:

  • Proposed travel dates
  • Where you intend to stay
  • The cost of your trip
  • Your home address and how long you have lived there
  • Your parents’ names and dates of birth
  • Your annual income
  • Details of any criminal, civil or immigration offences you have committed

You may also be asked for:

  • Your travel history over the previous ten years
  • Your employer’s name and contact details
  • Your partner’s name, date of birth and passport number
  • Details of any family members you have in the UK

You will need to pay the business visit visa fee.

Your application can be made up to three months before you wish to travel to the UK and we can prepare this on your behalf.

You will need to make an appointment at a visa application centre to provide paperwork demonstrating to UKVI that you are eligible for the visa as well as to verify your identity and have your photograph and fingerprints taken.

What Documents Do I Need For A Business Visit Visa?

UKVI will need to see documents relating to your immigration history, your economic circumstances, family details, including ties to your home country, and persuasive evidence showing that you intend to leave at the end of your visit.

We can work with you to identify the right documents to provide showing that you are eligible and that you will be able to support yourself for the duration of your trip and pay for the cost of returning home.

Securing A UK Sponsor Licence

An application for a sponsor licence requires comprehensive paperwork in support, showing that you and your business are eligible and demonstrating that you have the capacity to manage a sponsor licence once it has been issued.

You will need to put robust processes in place for running the licence and reporting on the certificates of sponsorship that you issue to overseas workers. We can advise on this and work with you as needed to ensure that you have the support and guidance necessary to comply with the strict sponsor licence regulations.

It is also necessary to show that your organisation has a genuine need to take on overseas workers. The authorities will need to see evidence that you have a real need for the proposed positions to be filled and that the roles have the required salary and skill level.

You will need to appoint one or more individuals to deal with your immigration affairs. The positions to be filled are:

  • An authorising officer with overall control;
  • A key contact to communicate with UK Visas and Immigration; and
  • A level 1 user who will deal with the day-to-day management and use the government’s sponsorship management system.

One person can take on all of the roles, or you can choose to have different individuals involved.

We also deal with sponsor licence rejections, renewals and applications to upgrade a downgraded sponsor licence. In the event that you have been downgraded, we can assist in ensuring you meet the necessary compliance criteria and that you have the right systems in place in respect of record-keeping and reporting, to avoid further issues arising in the future.

Business Immigration Advice And Visa Applications

We deal with applications for a full range of business visas. We can work with you to establish the best visa for your situation and prepare the application on your behalf, ensuring you have the right documentation in support. In addition, we can put together applications for family members and dependants if they need visas to accompany you to the UK.

If you have had your business visa rejected, we can advise you of the strengths and weaknesses of your case, whether it will be possible to make a fresh application or what alternatives might be available.

Sponsor Licence Applications

We routinely advise and represent businesses in obtaining, renewing and upgrading sponsor licences. This is the licence that allows you to issue certificates of sponsorship to overseas workers, enabling them to apply for the necessary UK work visa.

To secure a sponsor licence, the authorities will need to see substantial documentation showing that your business is eligible and that the post you are offering is one that genuinely needs to be filled by an overseas worker. We can identify the strongest possible evidence to support your application and ensure that you have documents to satisfy all of the eligibility criteria.

You will need to appoint certain officers to manage the licence, issue certificates of sponsorship and deal with the ongoing record-keeping and reporting. We also provide advice and guidance in setting up the systems you will need to operate a sponsor licence and maintain it in the way required by UK Visas and Immigration.

If you have been rejected for a sponsor licence or you have had your licence downgraded, we can work with you to identify the problems and how to resolve them. We also deal with sponsor licence renewals.

Sponsor Licence Applications And Management

If you wish to employ skilled workers who do not have an automatic right to work in the UK, your business will need a sponsor licence. This will allow you to issue Certificates of Sponsorship to overseas workers, which they will need in order to obtain a visa.

Applying for a sponsor licence can be a complex process. As an employer, both you and your business must be eligible and you must put systems in place to monitor sponsored workers. You will also need to check that the jobs you wish to fill are eligible and appoint people to manage you sponsor licence once it has been granted.

A large number of documents are needed to accompany an application for a sponsor licence. We can work with you to identify the strongest evidence you have available in support and ensure that you demonstrate that you meet all of the necessary criteria.

You will need to appoint one or more individuals to deal with the running of your sponsor licence once it has been issued. The roles to be filled are an authorising officer, a key contact and a level 1 user who will input information into the government’s sponsorship management system. The same person can take on more than one role if you wish.

We also deal with the renewal of your sponsor licence when this is due.

Swift, detailed and clear communication

I was very impressed with the services as Louisa was always available and communicating swiftly.

I was always informed of what was needed, when the tasks would be done from her side and she always kept to the promise.

The cover letter was of good quality – detailed, clear and outlining relevant points and legislation etc.

Louisa prompted me to provide as much evidence as possible to cover all bases which most likely enhanced the strength of the applications.

Overall, I am very happy with the services provided by Louisa and your firm.
