Can I Get A Spouse Visa Extension After 5 Years?

Having a spouse visa for five years is a possible route to ILR in the UK. A spouse visa is granted for 2 years and 9 months and can be renewed for 2 years and 6 months. This means that once a visa has been renewed, if you abide by the terms of the visa, you may be eligible to apply for ILR if you are on the 5-year route.

If you move from a spouse visa to ILR, you will no longer need to apply for visa extensions as you will have settled status in the UK. You will be able to live and work in the UK and you may ultimately be able to become a British citizen.

  • You have adequate accommodation in the UK and can pay for this without recourse to public funding

Spouse Visa Financial Requirement

Spouse visa financial requirements are not always straightforward, and the amount required will depend on whether you will be relying on income or savings.

Spouse Visa Income and Financial Evidence

When applying for a UK spouse visa, it’s important to demonstrate that you can adequately support yourself and your partner without needing public funds. There are several ways to prove this, depending on your personal and financial situation.

Income can come from a variety of sources. The most common is employment income from a job that has been held for a period of time, either six months or less. Both salaried and non-salaried roles can be considered, and different approaches may apply depending on the length of employment and the consistency of earnings.

Self-employed individuals, company directors, and business partners may also use their business income to support the application. In such cases, financial documents relating to a full tax year are typically required.

Other income types may be taken into account, such as rental income, pensions, or dividends. In some situations, different income sources can be combined to demonstrate financial stability. If your income is from one of these sources, we can guide you on how best to present this in your application.

Using Savings instead of Income

If you prefer, or if your income alone isn’t enough, you might be able to rely on savings to meet the financial requirement. These savings need to have been in your name (or your partner’s) and held in a personal account for a certain period before applying.

Savings can come from various sources, such as personal funds, inheritance, or money from selling property or investments—as long as you can show the required documentation.

Every case is unique, and the right approach depends on your personal and financial circumstances. If you’re unsure about what counts or how to present your finances clearly, we’re here to help make the process as smooth as possible.

Evidence That You Meet The Spouse Visa Financial Requirement

When you apply for a spouse visa, you will need to provide a substantial amount of documentation showing that you meet all of the eligibility criteria, including the minimum financial requirements.

Our spouse visa experts will go through the paperwork that you have available and select the documents that best support your application. Where necessary, we will work with you to obtain further items.

When Is It Not Necessary To Meet The Minimum Income Requirement?

If you or your partner are in receipt of benefits in respect of a disability or a role as a carer, then it will not be necessary meet the minimum income requirement. Instead, you will need to show that you have enough money for accommodation and living expenses for yourselves and any children you are supporting, without recourse to public funds.

If You Cannot Meet The Spouse Visa Financial Requirement

If it would be a breach of your human right to a private and family life to prevent you from coming to the UK, you may be able to secure a spouse visa even if you and your spouse are not financially eligible.

If you have a child who has lived in the UK for at least seven years, who holds British or Irish citizenship and it would be unreasonable for them to leave the UK, you may also be granted a spouse visa.

To discuss your application and how to demonstrate your eligibility, call us today and we will do all we can to help you.

What Are The Spousal Visa UK Requirements?

To be eligible for a UK spousal visa, you need to be able to prove the following:

  • Your relationship is a genuine one
  • You will be living with your spouse or partner permanently once your visa is granted
  • Your UK sponsor meets the relevant financial support criteria (some applicants may be exempt from this requirement if they receive certain benefits)
  • You meet the financial support requirements for any dependent children applying with you or already living in the UK—unless they are British or Irish citizens, or they hold settled or pre-settled status
  • You meet the minimum required standard of English language
  • You need to ensure that the UK sponsor has adequate accommodation in the UK
  • Your marriage is a legal one and is recognised in UK law

If you do not meet the financial requirements, you may still be able to apply for a spousal visa if you have a child in the UK who is a British or Irish citizen, they have lived in the UK for at least seven years and it would be unreasonable for them to leave.

In some circumstances, you may be able to use savings towards your financial requirements.

You may also be able to apply for a visa if it would breach your human rights for you to live elsewhere, for example, if your right to a private and family life would be breached.

Applying For A Spousal Visa UK

The application is made online, and there is an application fee and health surcharge to pay. It is essential to provide the right documents in support of your application, or there is a risk that it will be rejected.

We can go through your application in detail with you and ensure that you meet each of the criteria and that you have the most persuasive documents to send to UK Visas and Immigration in support. These could include the following:

  • Your marriage certificate
  • Evidence of the marriage ceremony
  • Evidence of time spent together, such as correspondence, messages and evidence of attending events together
  • Bank statements proving that you meet the minimum financial requirements
  • Evidence of adequate UK accomodation
  • The results of a secure English language test showing that you have sufficient ability in English or evidence that you hold a UK degree or a degree taught in English of a sufficient level
  • Your passport or other valid travel identity document
  • A copy of any expired passports
  • Tuberculosis test results, if you are from an affected country
  • Certified translations of documents that are not in English or Welsh

A range of other information is also required, including your personal details, those of your parents, information about any previous immigration applications and any criminal convictions.

You will also need to provide your biometric information. This is usually done at a UK Visas and Citizenship Application Services service point.

How Do I Apply For A UK Spouse Visa?

Spouse visa applications are made online. We can prepare a visa application on your behalf, ensuring that it is as strong as possible.

The key to a successful application is providing the right documentation in support, showing that you are eligible. We can work with you to establish what paperwork you have available to prove that you satisfy each requirement.

This includes evidence that your relationship is genuine and subsisting. If this is not clearly proved, UK Visas and Immigration may delay your visa decision until they have interviewed you and carried out checks. They may also want to visit your home. This can mean you may have to wait many more weeks for a decision. Providing clear evidence that your marriage is genuine is crucial if you want to avoid delays.

Before preparing your application, we will check that a spouse visa is the best option for your circumstances, taking into account both your current situation and your long-term aims.

Extending A Spouse Visa

A spouse visa lasts for two years and nine months (including the three month visa stamp to enter the UK), after which time it will need to be renewed if you wish to remain in the UK. A renewed spouse visa lasts for two years and six months. It may be possible to apply for indefinite leave to remain after you have lived continuously in the UK on a spouse visa for five years.

We can put together an application for a spouse visa extension on your behalf and ensure that you have the right documents in support.

What is the requirement for spouse visa at UK?

The first requirements apply to your spouse, who should be:

  • British or Irish or have indefinite leave to remain, refugee status or humanitarian protection or be from the EU, Switzerland, Norway, Iceland or Liechtenstein and hold pre-settled status, meaning they were living in the UK prior to 1 January 2021
  • Aged 18 or over
  • In a legal marriage with you that is recognised under UK law

The requirements that you will need to satisfy are that you have:

  • An acceptable standard of English
  • You can support yourself and your dependants financially
  • You have adequate UK accomodation

If you do not satisfy these criteria, then you may still be eligible for a spouse visa if:

  • You have a child who is British or Irish or who has lived in the UK for seven years or more and it would not be reasonable to require them to leave the UK
  • Your human rights would be breached if you were not granted a visa

Proving you meet the requirements for a spouse visa

UK spouse visa requirements mean that you must provide evidence with your application showing that you satisfy all of the necessary criteria.

UK spouse visa language requirement

You will usually have to prove that your knowledge of the English language meets a certain standard, except in some situations such as if you are over 65 or if you are from certain English-speaking countries or you hold a degree that was taught in English.

Proof is generally provided by taking and passing an approved English language test.

UK spouse visa financial requirement

To sponsor a partner under the UK Spouse Visa route, the UK-based sponsor must meet a minimum income threshold. This requirement ensures that the couple can support themselves without needing to rely on public funds. In some circumstances, such as where the sponsor is receiving certain benefits, an exemption from the financial requirement may apply.

If you have children who are not British or Irish citizens, do not hold pre-settled status, or are not permanently settled in the UK, you will need to meet a higher income threshold to show that you can support them as well.

Applicants can meet the financial requirement using:

  • Employment or self-employment income
  • Income from company directorships or pensions
  • Dividends, rental income, or other acceptable sources of funds

You will need to provide supporting documents, such as:

  • Payslips
  • Bank statements
  • A letter from your employer confirming details of your job (e.g. salary, job title, type of contract, and duration of current earnings)

UK spouse visa requirements – fees

When applying for a UK Spouse Visa, you must pay an application fee. The amount varies depending on whether you apply from within or outside the UK.

In addition to the visa fee, there is also a mandatory healthcare surcharge, which covers access to the National Health Service (NHS) for the duration of your visa.

Other UK spouse visa requirements

You are also required to provide full information in support of your application, including your passport or other valid travel identity document, a copy of your biometric residence permit if you hold one, tuberculosis test results if you are from an affected country and a certified translation of any documents that are not in English or Welsh.

Understanding The UK Spouse Visa

The UK spouse visa is intended to allow couples to live together where they are in a long-term relationship, including marriage or civil partnership.
As well as being available to a spouse of a British or Irish citizen or someone with settled status in the UK, a spouse may also be able to apply to join a partner who has refugee status in the UK or humanitarian protection in the UK.

What Is Spouse Visa UK?

A spouse visa UK allows you to stay in the country for two years and nine months, provided you are already married. If you are applying as a fiancé or fiancée or proposed civil partner, then you will be allowed to stay for six months so that you can marry or enter into a civil partnership. You can then apply to extend your stay.

Those holding a spouse visa as a married person or civil partner can apply for a visa to extend their stay before their existing visa expires. Up to 28 days from the old visa can be carried forward to the new visa.

Can I Switch To A Spouse Visa?

Depending on circumstances, you may be able to switch to a spouse visa from another type of visa, provided that your partner is not in the UK on a temporary work or student visa. If they are, you may still be able to stay with them, but you should apply as their dependant.

If you have an existing visa for six months as a fiancé, fiancée or proposed civil partner or you have been given permission to stay in the UK to await the outcome of a family court case or a divorce, you can apply to switch to a spouse visa from within the UK.

For other applications, you will need to apply from outside of the UK. This means that if you are in the UK as a visitor or you hold a visa that is valid for no more than six months, you will need to leave the UK and apply to switch to a spouse visa from overseas. The application should be made online.

If your application to switch to a spouse visa is successful, you will be able to stay for two years and nine months.

Securing a UK Spouse Visa

The spouse visa application process can be complicated and it is important to ensure that the forms are correctly completed and that you have all of the necessary documents in support. It is often necessary to provide a wide range of evidence along with your spouse visa application.

Our team has extensive experience in making successful spouse visa applications. If you ask us to represent you, we can ensure that you have the correct documents in support and that your application is as strong as possible.

How To Renew Spouse Visa UK

The requirements for a spouse visa renewal or extension are strict. You will need to prove that your relationship is genuine and subsisting and that it is a legally recognised marriage or civil partnership.

In renewing a UK spouse visa, you will also have to provide evidence that you have been living with your husband or wife or civil partner during the time you have spent in the UK so far. In addition, you will need to confirm that you intend to continue to do so.

Financial requirements for renewing UK spouse visa

When renewing a UK Spouse Visa, you and your partner must continue to meet the minimum financial requirements. The required income level for renewals may differ from that of new applicants.

If you are also supporting children who are not British or Irish citizens, or who do not have settled or pre-settled status, you will need to demonstrate additional income to meet the financial requirement.

Income that can be used towards the required total includes:

  • Income from your UK job as shown on your payslips or P60
  • UK self-employment income, as accounted for on your Self Assessment tax return
  • Money from a pension
  • Income from other sources such as property rental income or share dividend income

You can use a combination of income sources to meet the necessary minimum amount.

To prove your income is at the required level, you will need to provide documentary evidence, such as:

  • Payslips for the previous six months
  • Bank statements
  • A letter from your employer (or your spouse’s employer)

You can also meet the requirements in full or in part with cash savings.

Other Requirements:

You will also need to show that you meet the minimum standard in the English language.

The visa authorities will check whether there are any grounds to reject your spouse visa extension request, such as a breach of your immigration and visa conditions or a criminal conviction.

You will need to show you meet the test for adequate accomodation.

Making A Spouse Visa Renewal Application

Applying to renew or extend a UK spouse visa is not always straightforward. The UK Visas and Immigration authorities need to see a full range of supporting evidence and if some information is left out by mistake, your application will be rejected.

We can put together a strong application on your behalf and ensure that you have the best possible chance of success.

An additional fee applies for this expedited service.

In some cases, you may be eligible to request a super priority service, which provides a decision by the end of the next working day. Please note that this option is not available if you are applying using the ‘UK Immigration: ID Check’ app. An additional fee applies for this service.
