What Are The Spousal Visa UK Requirements?
To be eligible for a UK spousal visa, you need to be able to prove the following:
- Your relationship is a genuine one
- You will be living with your spouse or partner permanently once your visa is granted
- The UK Sponsor meets the minimum financial requirement, which is an income of at least £29,000 a year. (Certain benefits provide an exemption from the financial requirement)
- You meet the minimum financial requirements for any children who are applying with you or who are living in the UK and who are dependent upon you or your partner, unless they are British or Irish citizens or hold settled or pre-settled status; the amount required is £3,800 for the first child and £2,400 for each additional child
- You meet the minimum required standard of English language
- You need to ensure that the UK sponsor has adequate accommodation in the UK
- Your marriage is a legal one and is recognised in UK law
If you do not meet the financial requirements, you may still be able to apply for a spousal visa if you have a child in the UK who is a British or Irish citizen, they have lived in the UK for at least seven years and it would be unreasonable for them to leave.
In some circumstances, you may be able to use savings towards your financial requirements.
You may also be able to apply for a visa if it would breach your human rights for you to live elsewhere, for example, if your right to a private and family life would be breached.
Applying For A Spousal Visa UK
The application is made online, and there is an application fee and health surcharge to pay. It is essential to provide the right documents in support of your application, or there is a risk that it will be rejected.
We can go through your application in detail with you and ensure that you meet each of the criteria and that you have the most persuasive documents to send to UK Visas and Immigration in support. These could include the following:
- Your marriage certificate
- Evidence of the marriage ceremony
- Evidence of time spent together, such as correspondence, messages and evidence of attending events together
- Bank statements proving that you meet the minimum financial requirements
- Evidence of adequate UK accomodation
- The results of a secure English language test showing that you have sufficient ability in English or evidence that you hold a UK degree or a degree taught in English of a sufficient level
- Your passport or other valid travel identity document
- A copy of any expired passports
- Tuberculosis test results, if you are from an affected country
- Certified translations of documents that are not in English or Welsh
A range of other information is also required, including your personal details, those of your parents, information about any previous immigration applications and any criminal convictions.
You will also need to provide your biometric information. This is usually done at a UK Visas and Citizenship Application Services service point.
