Who Can Apply For A Spouse Visa?

If you need a spouse visa, both you and your spouse must meet a range of eligibility criteria and should intend to live together in the UK once the visa is granted.

Your spouse must be aged 18 or over and should be one of the following:

  • A British or Irish citizen
  • Someone with UK settled status, such as indefinite leave to remain
  • A holder of a Turkish Businessperson visa or Turkish Worker visa
  • A holder of protected status as a refugee or humanitarian protection
  • Someone with permission to stay in the UK as a stateless person

You need to prove the following:

  • You are in a genuine and subsisting relationship
  • You have suitable accommodation available to you in the UK
  • Your marriage is recognised by UK law
  • You and your spouse meet the minimum financial requirement
  • You have a sufficient standard of English

How Do I Prove I Am Eligible For A Spouse Visa?

You will need to provide a wide range of documents to demonstrate that you meet all of the spouse visa requirements. This will usually include:

  • Documents that verify your identity, such as your passport, former passports and biometric information
  • Proof that you are married and that your relationship is genuine, from documents such as shared utility bills, joint tenancy agreements, evidence of time spent together and communication between you
  • A statement from your spouse giving details of your relationship
  • Bank statements showing income and savings
  • Payslips and written confirmation from your spouse’s employer setting out details of their job and income
  • Proof that you have suitable accommodation arranged in the UK
  • Evidence that you meet the required standard of English, which will usually be by passing an approved English language test

Hannah was invaluable in our fiancee and subsequent spouse visa applications. She was very informative during our initial consultation and set out our options clearly. During our fiancee visa application, there was a hiccup on the Home Office’s behalf where they didn’t follow their own guidelines and they refused the visa.
