Am I Eligible For A UK Spouse Visa?
To apply for a UK spouse visa, you need to satisfy the following criteria:
- Your spouse is based in the UK and:o Is British or Irish
o Has settled status, EU settled status, Indefinite Leave to Remain or permanent residence
o Has refugee status, UK humanitarian protection or permission to stay in the UK as a stateless person
o Has a Turkish businessperson visa or a Turkish worker visa - You are in a marriage or civil partnership that is recognised in the UK
- Your English is of a sufficiently good standard
- You can financially support yourself and your dependants
You must intend to live with your spouse in the UK once your visa has been granted.
A similar visa is also available for partners who have been living together for at least two years.
If you do not qualify under the spouse visa rules, there may be another option open to you, and we can discuss this. For example, if you have a child who is a British or Irish citizen and they have lived in the UK for at least 7 years, we can make the case that it would be unreasonable for them to have to leave.
Documents In Support Of A Spouse Visa Application
We will need to provide UK Visas and Immigration with documentary evidence of the following:
- Your identity
- Your relationship
- Your spouse’s status
- Your standard of English
- Your income and financial status, showing that you meet the minimum income requirement
- Tuberculosis test results, if you are from an affected country
This may require a large amount of paperwork and we can advise you of the right documents to support your application.
Any documents not in English or Welsh will need to be accompanied by a certified translation.
How Long Can I Stay In The UK On A Spouse Visa?
A spouse visa is valid for two years and nine months (including the three months visa stamp to enter the UK). If you extend a spouse visa or switch to a spouse visa, it will be valid for two years and six months.
