Skilled worker case study:
We were instructed by a tier 2 migrant to represent her for her switch to a Skilled worker visa.
The client initially approached us by submitting a free enquiry to our general line asking if she could make an application for indefinite leave to remain as a Tier 2 Migrant or whether she should switch from Tier 2 to Skilled worker/Global talent instead.
After taking further information from the client, we set up an advice session and advised the client that she would not be eligible to apply for indefinite leave to remain, despite having completed five years in the UK as a tier 2 migrant, as she was about to hand in her notice with her current employer and a requirement for settlement as a tier 2 migrant is that the employer ‘requires the applicant to work for them for the foreseeable future’.
The client further instructed us to prepare her application for an in-country switch to Skilled worker migrant (after advising her that the Global talent visa would be more cumbersome to acquire as she had not yet been endorsed by an appropriate body).
We sent the client a document checklist of evidence required, prepared the application and agreed to submit within 4 working days of receipt of all required evidence in comparison to our usual 10 working days timescale as the client required her BRP card prior to commencing her new employment as a condition of being offered the new position.
We promptly booked a biometric appointment for our client to attend 2 working days after submission and uploaded all evidence ready for her to attend the appointment.
Our client received her decision 36 working days after the biometric appointment.
