When Do You Need To Extend A Spouse Visa?

If you hold a spouse visa, this will generally allow you to stay in the UK for 2 years and 9 months. If you have extended your spouse visa or switched to a spouse visa from another type of visa, you can stay for 2 years and 6 months.

You should ensure that your spouse visa extension application is submitted before your visa expires. Failure to do this means you will be classed as an overstayer, which could affect your immigration status and spouse visa renewal application and also mean that you have to leave the UK.

It is usually recommended that you submit your renewal application up to 28 days before the visa expiry date.

Spouse Visa Extension Eligibility

To be eligible to extend a spouse visa, you will need to meet the following criteria:

  • Your relationship is genuine
  • You have been living together in the UK throughout the period of your spouse visa
  • You meet the minimum income requirements
  • You meet the minimum English language requirements
  • You have not breached the terms of your visa, and you do not have any serious criminal convictions

What Documents Are Needed To Extend Spouse Visa?

UK Visas and Immigration (UKVI) will need to see evidence that you satisfy their requirements for extending a spouse visa. Documents to be provided will usually include:

  • Your valid passport
  • Your marriage certificate or civil partnership certificate
  • Evidence of your relationship, such as correspondence, joint bank statements, photographs and joint bills
  • Proof that you meet the minimum financial requirements, such as bank statements, payslips and tax returns
  • Evidence that you meet the minimum English language requirement, such as a degree certificate from a qualifying degree taught in English or the results of an approved English language test

How Do I Extend Spouse Visa?

You will also need to ensure that UKVI has your up-to-date biometric information. You can provide this at a visa application centre.
