Applying For Indefinite Leave To Remain
There are several routes to ILR, and your eligibility will depend on how long you have been in the UK and on what basis this is.
If you hold a UK work visa, you can usually apply for ILR after five years.
You may also be able to apply for ILR if you have a partner, parent, child or other relative who is settled in the UK and you have a visa yourself.
Indefinite Leave To Remain Fee
When you apply for ILR, you will need to pay an Indefinite Leave to Remain application fee. This is £2,885 for each applicant.
UK Visas and Immigration (UKVI) aims to provide a decision within six months. During this time, you may not leave the UK, Ireland, the Channel Islands or the Isle of Man or your application will be withdrawn.
In some cases, you can pay extra to fast-track your application. If the priority service is available, this should provide you with a decision within five working days. If you are making a family application from outside of the UK, it will be up to 30 working days. The priority service costs an extra £500.
A super priority service may also be available. Once you have uploaded all of the necessary information and attended an appointment to prove your identity, UKVI will aim to give you a decision by the end of the next working day after your appointment or two working days after your appointment if it is at the weekend or on a bank holiday.
Indefinite Leave To Remain Minimum Income Requirement
Depending on your visa, you may need to satisfy a minimum income requirement when applying for ILR.
If you are on a spouse visa, you and your spouse will need a combined income of at least £18,600. If you first applied for your family visa on or after 11 April 2024, the minimum income requirement is higher, at £29,000. Alternatively, if you have cash savings of £88,500 or more, this will satisfy the financial element of your application.
You will also need an additional £3,800 per year for your first child and £2,400 a year for each subsequent child.
If you hold a skilled worker visa, you will generally need to show that you earn the highest of:
- £25,600 per year
- £10.10 per hour
- The going rate for your job
For scale up workers, the salary requirement depends on when you received your most recent certificate of sponsorship and ranges from £33,000 to £36,300 per year. You must also have earned this in at least two of the three previous years.
