This means that once a visa has been renewed, if you abide by the terms of the visa, you may be eligible to apply for ILR if you are on the 5-year route.

If you move from a spouse visa to ILR, you will no longer need to apply for visa extensions as you will have settled status in the UK. You will be able to live and work in the UK and you may ultimately be able to become a British citizen.

To be eligible to move from a spouse visa to ILR, you need to satisfy UKVI on the following points:

  • Your spouse or civil partner is a British or Irish citizen or is settled in the UK

  • You intend to keep living with your spouse or civil partner

  • You have adequate accommodation in the UK and can pay for this without recourse to public funding

  • You have spent 60 months in the UK under a spouse visa

You can also apply for ILR for dependent children who have held family visas for the same period of time.

What are UK spouse visa requirements?

To be eligible for a UK spouse visa, your spouse must be aged 18 or over and will usually be either a British or Irish citizen or hold settled or pre-settled status or protected status.

If you apply for a spouse visa, you must intend to live permanently with your partner in the UK once your application has been submitted.

You will need to provide UKVI with evidence of the following:

  • You are in a civil partnership or legal marriage that is recognised in the UK
  • The UK sponsor can support you and any dependants, as required under current UKVI guidelines (some applicants may be exempt from certain requirements depending on their circumstances)
  • The UK sponsor has suitable accommodation available in the UK for you and any dependants
  • You meet the required standard of English language proficiency

How do I show that I meet the requirements for spouse visa UK?

Your spouse visa application must be accompanied by a wide range of documents that prove you are eligible. This includes:

  • Your marriage certificate or civil partnership certificate
  • Bank statements and payslips showing your income
  • A letter from both your employer and your partner’s employer
  • Alternatively, evidence of income from self-employment or a company owned by you or your partner, which will include a range of documents such as annual accounts
  • Evidence that you are in a genuine relationship, for example, documents showing that you live together, share expenses and have been together for a period of time
  • Evidence of adequate UK accomodation
  • Proof of your English language abilities, which could be the results of an approved English language test or evidence that you hold a degree from a UK university or a degree taught in English t an approved overseas university

You will also have to provide the following information:

  • Your full name, any other names you have and date of birth
  • Your valid travel identity document, usually a passport
  • Copies of previous passports, including the visa stamps and photo pages
  • Your biometric identity, ie. your photo and fingerprints, which you can submit at a visa application services point
  • Details of criminal convictions, if any
  • Details of previous visa applications, if any
  • Your National Insurance number, if any
  • Tuberculosis test results, if you are from a relevant country
  • Details of your parents’ dates of birth and nationality if your application is being made from outside of the UK

You will need to provide certified transactions of any documents that are not already in English or Welsh.

What Are The Spousal Visa UK Requirements?

To be eligible for a UK spousal visa, you need to be able to prove the following:

  • Your relationship is a genuine one
  • You will be living with your spouse or partner permanently once your visa is granted
  • Your UK sponsor meets the relevant financial support criteria (some applicants may be exempt from this requirement if they receive certain benefits)
  • You meet the financial support requirements for any dependent children applying with you or already living in the UK—unless they are British or Irish citizens, or they hold settled or pre-settled status
  • You meet the minimum required standard of English language
  • You need to ensure that the UK sponsor has adequate accommodation in the UK
  • Your marriage is a legal one and is recognised in UK law

If you do not meet the financial requirements, you may still be able to apply for a spousal visa if you have a child in the UK who is a British or Irish citizen, they have lived in the UK for at least seven years and it would be unreasonable for them to leave.

In some circumstances, you may be able to use savings towards your financial requirements.

You may also be able to apply for a visa if it would breach your human rights for you to live elsewhere, for example, if your right to a private and family life would be breached.

The application is made online, and there is an application fee and health surcharge to pay. It is essential to provide the right documents in support of your application, or there is a risk that it will be rejected.

There are several routes to ILR, and your eligibility will depend on how long you have been in the UK and on what basis this is.

If you hold a UK work visa, you can usually apply for ILR after five years.

You may also be able to apply for ILR if you have a partner, parent, child or other relative who is settled in the UK and you have a visa yourself.

Indefinite Leave To Remain Application Process

When you apply for ILR, you will need to pay an application fee. UK Visas and Immigration (UKVI) aims to provide a decision within six months. During this time, you may not leave the UK, Ireland, the Channel Islands, or the Isle of Man, or your application will be withdrawn.

In some cases, you can pay extra to fast-track your application. If the priority service is available, this should provide you with a decision within five working days. If you are making a family application from outside of the UK, it will be up to 30 working days. The priority service may come at an additional cost.

A super priority service may also be available. Once you have uploaded all of the necessary information and attended an appointment to prove your identity, UKVI will aim to give you a decision by the end of the next working day after your appointment or two working days after your appointment if it is at the weekend or on a bank holiday.

How Do I Renew Indefinite Leave To Remain?

Ordinarily, Indefinite Leave to Remain does not expire. However, you do need a valid Biometric Residence Permit (BRP) and this may expire.

The UK Visas and Immigration (UKVI) department of the Home Office will contact you to set you up with access to a new eVisa. This is an online record of your immigration status and will be replacing BRPs.

If your BRP has expired and you do not yet have access to your eVisa, you can prove your immigration status in a different way.

To provide evidence of your right to be in the UK to a potential employer or landlord, you can ask UKVI to provide you with a share code. This will allow the employer or landlord to go online and check your immigration status.

Alternatively, you can show them your immigration documents. It is up to you which option you use, and the employer or landlord cannot object or ask you to prove your status in a different way.

If you need to show the NHS that you have the right to be in the UK, you can ask them to verify this with UKVI.

If you will need a new BRP to re-enter the UK, you can apply for a replacement BRP visa.

When Does Indefinite Leave To Remain Lapse?

If you have ILR, but you stay outside of the UK for more than two years, your ILR will automatically lapse.

You may be able to re-enter the UK if you apply for a returning resident visa.

How To Get Indefinite Leave To Remain

The length of time you need to be in the UK to apply for Indefinite Leave to Remain will vary depending on your circumstances. For many visa holders, including those with skilled worker visas, you may be eligible to apply for ILR after five years.

During this five-year period, you cannot have spent more than 180 days out of the UK in any twelve-month period.

You will typically need to meet additional eligibility requirements. One key requirement is demonstrating that your salary meets the necessary threshold. This is assessed based on a set minimum level or the standard rate of pay for your specific role—whichever is higher.

If your job is on the official list of shortage occupations, you do not need to meet the minimum income requirement

  • Your employer still needs you and you will continue to meet the minimum income requirement
  • You have passed the Life in the UK Test
  • You are of good character
  • You have not committed any criminal offences or breached the UK’s immigration rules

When Can You get Indefinite Leave To Remain?

If you satisfy the eligibility criteria, you can apply no earlier than 28 days before the date on which you will have been in the UK for five years or however long is appropriate for your ILR route.

You should not wait until your visa expires or you will need to renew your visa before you apply for ILR.

Why Apply For Citizenship After Indefinite Leave To Remain?

There are several advantages of having Citizenship rather than having ILR, including:

  • You can spend time outside of the UK without risking losing your status. If you hold ILR and you are absent for more than two years, your ILR will lapse
  • You are entitled to hold a British passport, which is considered one of the world’s strongest passports and which will allow you to travel visa-free or visa on arrival to around 190 countries
  • If you are a naturalised British citizen and you have a child, they will automatically have British citizenship, even if they were not born in the UK
  • As a British citizen you will have full voting rights. You will also be able to stand as a candidate. Those with ILR are restricted as to when they may vote and cannot hold office

Applying For Citizenship After Indefinite Leave To Remain

To be eligible to apply for Citizenship, if you are neither married to, nor in a civil partnership with a British citizen you need to have lived in the UK for the five years prior to the date of your application and have held one of the following for at least a year:

  • Indefinite Leave to Remain in the UK
  • Settled Status, which is similar to ILR and which is granted to those from the EU, Switzerland, Norway, Iceland and Liechtenstein
  • Indefinite Leave to Enter the UK

Other criteria are:

  • You are aged 18 or over
  • You are of good character
  • You are able to show that you were in the UK on the day five years before the date on which your application is received
  • You have the required level of English
  • You have passed a Life in the UK test
  • It is your intention to keep living in the UK

You should not have spent more than 450 days outside of the UK during the 5 years prior to your application and no more than 90 days outside of the UK during the year before the date of your application. You must not have broken any immigration laws.

If you do not hold ILR, then there may be other options and we can advise you of these.

If you are married to, or in a civil partnership with, a British citizen, the rules are slightly different. You must be:

  • settled at the time of the application
  • must have been legally living in the UK continuously for a period of at least three years
  • must have been physically present in the UK on the day three years before the date on which your application is received
  • You should not have spent more than 270 days outside of the UK during the 3 years prior to your application and no more than 90 days outside of the UK during the year before the date of your application.
  • You must not have broken any immigration laws
  • You must possess knowledge of the English language and have passed a Life in the UK test

There are of course some exceptions to these guidelines that are beyond the scope of this short Article.

Making An Application For Citizenship After ILR

Why Make An Indefinite Leave To Remain Application?

If you make a successful ILR application, you will have the right to stay in the UK for as long as you wish. If you are eligible, you will be able to claim benefits and you will no longer need to pay an NHS surcharge.

You will also be able to leave and re-enter the UK, provided that you do not stay outside of the UK for more than two years.

For most applicants this is five years, including those on long-term work visas, although on some routes it may be only two or three years, while others are 10 years.

Routes to Indefinite Leave to Remain include on the basis of:

  • A long-term work visa
  • You have family in the UK
  • On the basis of your private life, for example, if you were born in the UK and lived here for 7 continuous years or you have a visa based on your private life and have lived in the UK continuously for 10 years
  • You have a UK ancestry visa and have lived in the UK for five years or more

There are a range of requirements, which may vary slightly depending on your route. For skilled worker visa holders, eligibility criteria include:

  • Not having spent more than 180 days outside of the UK in any twelve-month period during the qualifying period
  • Meeting the minimum salary requirements
  • You are still needed for your job and you will continue to meet the minimum salary requirements
  • You have passed the Life in the UK test

Making An Indefinite Leave To Remain Application

An ILR application is usually made online. We can work with you to check that you are eligible and to put together the paperwork that provides evidence of this. Where necessary, we will discuss what documents need to be obtained in support of your application. For example, if you hold a skilled worker visa, your employer will need to confirm in writing that you are still needed for your job and that your salary will meet a certain level.

If you hold a visa as the spouse or partner of someone who is settled in the UK, either as a British citizen or as an ILR holder, you may be able to make an ILR spouse application.
Eligibility criteria include:

  • You hold a visa as a husband, wife or civil partner and you have lived together with your partner since last renewing your visa
  • You intend to continue with the relationship
  • You have lived continuously in the UK for at least 5 years – this cannot include time spent on another visa or time prior to your marriage or civil partnership
  • You and your spouse or partner meet the minimum financial requirements, including additional sums for any children or dependants
  • You have passed the Life in the UK test
  • You have passed a secure English language test or you otherwise meet the minimum standard of English requirements

There are other routes to ILR which require a different amount of time to be spent living in the UK, including a 2-year route and a 10-year route. We can advise you if you are eligible under either of these, however the 5-year route is the most commonly available option.

Including Children On Your Indefinite Leave To Remain Application

If you are on the 5-year route, you can include your child on your ILR application if they meet the following eligibility criteria:

  • They are included on your family visa as a dependant and so have permission to be in the UK
  • They will live with you and you will support them financially without the need for benefits
  • They are not married or living independently
  • Your partner is their other parent, unless:

o You are solely responsible for your child
o Your child’s other parent is no longer alive
o There are compelling reasons that your child should be allowed to live with you in the UK

Children aged 18 or over will need to pass the Life in the UK test and must meet the minimum English language standards. They must also have been included on your family visa before they reached the age of 18.

There are several routes to ILR. For most visa holders, if you have lived in the UK for 5 years, you will be able to apply. This includes if you hold a skilled worker visa or another long-term work visa. We can advise you of the eligibility criteria, check that you meet them and put together the paperwork that proves this.

The five-year period should not include more than 180 days outside of the UK in any twelve-month period.

You may need to meet a minimum salary requirement. For Skilled Worker visa holders, this typically means earning at least the standard rate for your role or above a set threshold—whichever is higher. Exceptions may apply if your job is on the shortage occupation list. We’re happy to advise you on the expected salary for your role and help ensure you meet the necessary criteria.

You will need to demonstrate that you are still needed for your job when you apply and that you will continue to meet the minimum salary requirements. This is done by providing written confirmation from your employer or sponsor. Before applying for ILR, you are also required to sit and pass a Life in the UK test. If you have a visa allowing you to be in the UK as a spouse or relative of a British citizen or an individual with ILR, you may be able to apply for ILR yourself.

You will need to be married or in a civil partnership and have held a family visa continuously for 5 years, if you are on the 5-year route. You can tell whether you are on the 5-year route or a 2-year or 1-year route from the letter you have confirming your leave to remain in the UK.

When Do I Need A Biometric Residence Permit?

A biometric residence permit (BRP) is proof of your immigration status and includes other details, including your name, date and place of birth, any right to receive benefits and any conditions attached to your visa or other consent.

When you make a visa application or you apply for indefinite leave to remain, you will need to submit your biometric information – your digital photo and your fingerprints – at an approved site.

If you are in the UK, this is at a UK Visa and Citizenship Application Services service point or a Service and Support Centre. If you are overseas, it will be dealt with at a visa application centre.

If your visa or other application is approved, you will automatically be issued with a BRP.

Do I Have To Renew A Biometric Residence Permit?

A BRP issued with a visa usually expires at the same time as the visa. If your visa is due to expire, you will need to renew it if you wish to stay in the UK and you can resubmit your biometric information at the same time. How Do I Renew A Biometric Residence Permit?

To renew a BRP, you need to fill in an online form and put together documentary evidence of your continuous residence in the UK and of any changes in your circumstances that have occurred.

You must also pay a renewal fee and return your existing BRP to UKVI.

If you have indefinite leave to remain, your BRP may expire on 31 December 2024. The reason for this is that the government intends to digitalise immigration status.

Instead of holding a BRP, you will be able to set up an online UKVI account and view your immigration details online using the ‘View and prove your immigration status’ service.

Do I Need To Renew Indefinite Leave To Remain?

Indefinite leave to remain does not expire over time, but a biometric residence permit has an end date and failure to renew it could mean that you are fined and have difficulties moving forward.

For this reason, it is essential to check your BRP expiry date and make sure that you reapply in plenty of time, up to three months ahead of the expiry date.

Although ILR does not expire, in certain cases it could be revoked. For example, if you are outside of the UK for two years or more, you could lose your ILR status. If this happens, you may be able to apply for a returning resident visa. This must be accompanied by strong evidence in support and it is in the discretion of UKVI as to whether or not ILR is reinstated.

How Do I Renew A Biometric Residence Permit?

If you hold ILR, then you can apply to renew your BRP from within the UK by using the government’s ‘Update, replace or transfer a biometric residence permit’ service.

You will need to provide certain documents along with the application by way of evidence of your eligibility. This includes proof of your continuous residence in the UK and of any change in your details or circumstances. You will also need to pay a fee and return your existing BRP.

The government intends to end the use of BRPs and from 1 January 2025, holders of ILR will be able to prove their status digitally.

You will be able to create a UK Visas and Immigration (UKVI) account, which should be done before your BRP expires. You will then be able to use this account to access the ‘view and prove your immigration status’ service. This allows you to create a share code for anyone who needs to check your immigration status. For example, landlords must check that you have the right to rent and employers need to check that you have the right to work.

Once you have a UKVI account, you need to make sure that it is updated with any changes to your personal details and passport information.

Who Is Eligible For A Spouse Visa?

Your partner must satisfy one of the following criteria if you wish to apply for a UK spouse visa. They should be:

  • A British or Irish citizen
  • Settled in the UK, for example, because they have indefinite leave to remain or settled status
  • Holders of refugee status or humanitarian protection

You must intend to live together in the UK once the visa is granted and be in a marriage that is recognised in the UK. The relationship must be genuine.

UK Visas and Immigration will need evidence that you have the required standard of English and that you have the financial resources to support yourself and any dependants. You will also need to prove that you have suitable accommodation available.

What Documents Do I Need For A Spouse Visa Application?

You will need to compile a wide range of documents to provide clear evidence that you satisfy the spouse visa eligibility criteria. This could include:

  • A copy of your marriage certificate
  • Identity documentation, such as your passport or other valid travel identity document
  • Evidence that your relationship is genuine, which could be joint bills sent to your shared address, evidence of holidays spent together and correspondence between you and your spouse
  • Evidence given by your spouse confirming the details of your relationship
  • Bank statements showing that you have sufficient financial resources
  • Confirmation from your spouse’s place of employment of their income and position if you will also be relying on their salary to meet the financial criteria
  • Evidence of the accommodation you will be moving to if you are given a visa
  • Confirmation that your English is at the required level, for example, the results of a Secure English Language Test or SELT
  • Tuberculosis test results, where required

Documents that are not in English or Welsh will need to be accompanied by a certified translation.
